Exam Information & Requirements

A Patent agent is a person registered with Indian Patent Office whose name is entered in the patent agent register after being declared qualified in the patent agent examination conducted by the patent office. Patent Agents, also called Patent Attorneys are specialised Legal Advisors, similar to Lawyers, who advise their clients on how to protect their Intellectual Property Rights.

Eligibility?

A person shall be qualified to have his name entered in the register of patent agents if he fulfils the following conditions, namely:

  • (a) He is a citizen of India;
  • (b) He has completed the age of 21 years;
  • (c) He has obtained a degree in science, engineering or technology from any university;
  • (d) Has passed the PATENT AGENT examination prescribed for the purpose by The office of the Controller General of Patents, Designs & Trade Marks.

EXAM SYLLABUS and Pattern:

Paper / Subject Marks
Paper I - Patent Act and Rules 100 marks
Paper-II - Drafting and interpretation of Patent Specification and other documents 100 marks
Viva Voce 50 marks
Total Marks 250 marks

Viva-Voce examination will be conducted after the completion of the written exam. Only those candidates who have scored a minimum of 50% marks in each paper will be allowed to appear for Viva-Voce.

A candidate shall be required to secure a minimum of fifty marks in Paper-I and Paper-II and shall be declared to have passed the examination only if he obtains an aggregate of sixty per cent of the total marks.
