Motor Accidents Claims Tribunals (MACT): For the speedy disposal of third party claims and at a minimum cost, the Claims Tribunals have been constituted by different State Governments, under Section 110 of Motor Vehicles Act, 1939.
Section 173 provides for provision of filing Appeal for a person aggrieved by an award of MACT. However, there is a bar on filing appeal for an award of a Claims Tribunal if the amount in dispute is less than ten thousand rupees.
The Tribunals have all the powers and trappings of a Civil Court. One important adjunct of the power of a Civil Court being available to the MACT is the power in relation to review or recall of an award against the insurer in case fraud is established later.
Pay and Recover for victims on the road only: Supreme Court has clarified that in the absence of driving licence per se, the insurer cannot be asked to pay and recover.
